Sold car without RWC in Victoria

I sold my old registered car to some schmuck so said he take care of the RWC and transfer the vehicle over. Being foolish and just wanting to get rid of the car i took his word on it and gave him the car, plates and all.   Its been about 3 weeks and he still hasn't done it.  Vicroads say that to sell a registered car you must sell it with a valid Road Worthy Certifcate.    I rung Vicroads and they said i'd have to send a copy of the transfer form and they'll chase him up or cancel it if he doesn't respond.   The transfer  form i have doesn't obviously have a RWC number on it so i imagine if i do that i open myself to whatever punishment can be delt as to breaking the RWC sale  rule.   Any idea what the punishment might be and how best to avoid it ?  Am i better off just coming clean or doing nothing untill the registration natually runs out in August 2009 ?   I've checked all the road statutes and stuff for Victoria and there's no mention of what the penalty could be or whether it is acutally illegal.   Thanks

I just bought a registered car w/out a RWC in VIC, and have many times before hand, the purchaser has got 28days to transfer it into his name, then VicRoads will chase him up. Assuming he does this before the 28 day period, after he transfers the car into his name (which you can do w/out a RWC so I just found out) the purchaser has ANOTHER 28 days from the transfer date (plus or minus a couple... don't quote me on the time, just that they have more) to source a RWC and show it to VicRoads. I just went through this 2 weeks ago. Bought car sans-RWC, transfered into my name 2 weeks after the fact, and got a RWC 1&1/2 weeks later - no hassels from VicRoads, the lady said they do it all the time.

So long as you have the transfer form dated the day he took it, or even a bit of paper signed (by both of you) and dated with your vehicle info its all good. VicRoads are just worried about speeding fines being accurate etc. but you've got the date on the transfer form, so there's no worries, b/c if you get one in the mail you jsut fill out the back with his details (which should be on the transfer form). YOU shouldn't be in trouble, if the PURCHASER doesn't hold up his part of the bargain then he's in the ****. Sorry bout the length

Well firstly, without trying to be rude, your an idiot for the way you've gone about your business.  There is nothing stopping the new owner from running red lights, racing through speed cameras, driving off from petrol stations etc etc.


Come clean with your traffic authority. Tell them exactly what happened as they should be able to make a note that the vehicle is no longer yours.

You don't need a RWC to sell a car in VIC. Simply call Vic Roads and cancel the registration and plates, also advising of the current owners address if you have it.

The other option, if you choose to continue doing the stooge you sold it to a service, is to simply complete the components of the vehicle transfer that you can and hand it into VIC Roads.
They will chase it up. Again, you don't need a RWC to hand this in. It only means that when the guy comes to complete the transfer he will need to supply a RWC and or completely re-register the car.

It would be worth your while getting a stat dec done with the coppers just to make sure that you aren't liable for any violations that might have come up since the car hasn't been in your hands.

Learnt any lessons over this?

Whe i sold my Lib in Vic, purchaser was to get a RWC himself. I got the transfer papers, and filled them out but then got a photocopy of it and got him to fill that out also along with both our sigs and the dates. I left the dates off the original transfers for him to fill in when RWC was done.

Pays to have a signature and date of both parties somewhere in your possesion  for backup.
