Hi All,

Its been many moons since some git smashed my car and at that time I had full comp so everything was just kinda taken care of.

Don't panic ... the sh!tbox is still in one piece.

The situation is this,

My old man's magna was t-boned at an intersection and the car looks like its a write off. (yes I would have been aiming for it too)
 
It was the other drivers fault and this has been distinguished by the feds.

However,

The magna has compusary 3rd party so its not a case of my insurance people will call your insurance people while we go off hunting lions and drinking devonshire tea... chortle

As the story goes the towies rocked up and dragged the itsa****ty onto the truck and legged it for the smash repairs.

The towie tried to hit my old man up for the tow of which father told them to go piss in thier boot and swim.

The car has been at the smash repair for a week  waiting for the assessors to come look at it, Dad was told that he would have to foot a holding fee for the car while it was there.

I think this is BS as he wasnt at fault and he shouldnt have to pay for out of pockets.

IMO they should be charged back to the person at fualts insurrance company or thats what I would assume would be the correct way of going about it.

Dad was told that the cost of the tow and the holding fee would be taken off what he would get back if the car was written off.

Again I think the smash repairer is full of sh!t

Even if it was the norm to foot out of pockets the insurer should warrant this and absorb it into the claim total the same way we do surge claims at work. But as it stands no one from the other persons insurance has even spoken to my dad yet.... not sure if they have to or not , but would make sence to at lleast contact the person who's car your assessing.

Can anyone shed some light on this, I am dead set sure my old man is getting bent over on this one.

its an insurance company they'll do their very best to bend you over any day of the week such as I've experienced.

if you dad knows the insurer I'd suggest getting in contact with them and giving them a nudge, keep doing so every couple days if at first you don't succeed. the more annoying he is the faster they will deal with it.

at the end of the day its costing them (the insurer) money, so they'll take their sweet time to fork it over to you and the holding yard.

I'm fairly certain your old man shouldn't have to pay anything for holding n crap,  likely the guys just trying to get money from whoever he can fastest.

The crash repair guy is full of it, the other driver was proven to be in the wrong so all costs should come from their insurance company.
Provar is right, the only way to speed things along is to be really annoying to your insurance company and keep ringing them and each time get the name of the person you were talking to.

My thoughts exactly for all comments ... look thanks guys I will get the old boy to chase it up with thier insurance he would have had to have gotten an event number that they can link the claim to.
