Is using a UHF radio illegal whilst driving?

OK we all know that using a mobile whilst driving is illegal... what about using a UHF  portable radio?
or a walkie talkie.

can i suggest creating a poll for this topic? my opinion, no not illegal to talk on whilst driving as far as i know or truckers would be getting shafted  :shok: by the police to an extent that we would be informed through various media outlets.

police
ambulance
fire fighters
bus drivers
pilots
army
astronaughts
race car drivers

if all them can use hem when driving so can we

i think it is ok to use them whilst driving. of course, we would use them for cruises, but for city driving, i dont really see a need for them except for emergency vehicles etc

I think it depends on whether they are hand held, or wired in.
As I think in Vic the hand held ones are in the same as mobiles and are illegal.
But if its a proper CB, thats wired in, then its legal.

its kinda hands free, its the same and the hands free for a phone. to answer the call you press a small button on the wire same as when you want to talk in a CB

A CB can't truly be a hands free unit.

With most phone you can use speach to answer the phone, you can't on a CB, you have to push to talk.

Surely I would have thought that the use of a portable UHF CB radio was not comparable to that of a mobile phone.

I thought that the very reason that mobile phone usage had been made illegal was that you typically have to take your eyes (and attention) away from the road to operate it (ie. dial numbers, look up phone entries, etc). This was of course a potentially dangerous practice, with evidence linking mobile phone use to serious or fatal car accidents. Hence, they banned the use of mobile phones as a result (I'm not agreeing or disagreeing with the legalities, I'm just making the point that use of mobile phones is illegal because they want to deter people from doing things to take their attention off the road).

With a portable UHF CB however, you are only pushing one button to talk. And you don't even have to look to see where to push (usually!). You also usually don't have to change channel, as channels are usually pre-selected. You hardly ever have to take your eyes off the road as a result. So there haven't been many fatalities or accidents that have been attributied to use of a portable UHF CB. Hence, no legislation to make these items illegal.

That's just my 2 cents though. I have been known to have been wrong on occaision!! wink

One of the main reason why they banned using mobile phone was when you are talking on it you are discrated also, this is the same with CB's.

I was under the impression that it was illegal.

I always try to hide my use of the CB.  Don't want to find out whether it's illegal by being pulled over by the police...  smile

I always use the handsfree anyway.  I find that if I don't, then people will always have to repeat themselves because the first time someone radios through, the CB isn't close enough to my ear to hear all the words properly.

It is illegal accordingto the cop that confiscated the one my friend had in his car (he wasn't even using it at the time either)

Is he allowed to do that?  If that happened to me, I'd be looking at my Rights...
AFAIK, confiscation of personal property requires a lot of legal red tape.

I got pulled over for talking on a mobile phone (but was actually on a CB). I explained to the Cop it was a CB and he let me go.

Nah man, if the phone rings you HAVE to answer it... why else buy a mobile phone... I may someday be hanging from the Harbour Bridge with broken arms and broken legs, and if I may be carrying my mobile with me at the time, shit man, I'll definately be answering it.
