Had an accident, need advice

  Top of Page

Wasn't sure where to post this but my wife's car has been in an accident and I need advice on how to go about claiming insurance.

Wife's car is Toyota Camry (no snickering please smile and other car is Nissan something.

So the Toyota is leaving the multi level carpark at the shopping centre and it has one of those helical (or spiral) ramps to get up or down to the next level. This one is two lanes, one for cars going up and one for cars going down.

So halfway down she has to stop as there is a queue so the Toyota is stationary.
Up the ramp comes the Nissan and it gets a little bit past the Toyota (behind and to the right from Toyota perspective) and then stops.

Then it rolls down the ramp in a straight line and the back of the Nissan hits the right rear door and wheel arch of my wifes car. This is probably at a 70 or 80 degree angle because of the way the ramp curves around.

So the back of the Nissan is pretty badly damaged but the Camry door is slightly dented so you cannot open the door properly.

The owners of the other car admitted it was their fault after some cursing. I think they must have stalled or forgotten to brake and their car just rolled down the ramp.

Sorry for the long post.

So now the problem is we only have 3rd Party insurance, so our insurance company doesn't want to get involved as it is not our fault.
We have to contact the offending drivers insurance company to make sure that they have made a claim.
Unfortunately I cannot seem to contact these people on their home number.
I have got plates and drivers licence details.

Should I wait a bit longer and keep trying to contact them (it has been a few weeks) or should I call the coppers?

Thanks guys.

I thought all claims needed a police report?
Privately owned car park may be different but.
Hope you haven't missed the boat.

Depends on the state I think. In Vic you only call the cops if it cant be resolved and the person at fault will cop (pardon the pun) a fine. Just wait awhile first and try calling with a private number incase they're not picking up your calls.

^^^^  as above.   anything over $500  should be reported

get cops involved and report once again to your insurer what you have done.

They could help out more if needed & pushed.

Cool, I called the cops and they said to come in and make a report, then they can chase up where these people live and give me contact numbers etc.
But they can't do anything beyond that cos it is not a criminal offence or something so there will be no SWAT team busting down their door, dammit. smile

I've already got their address from the licence but I really want to sort this in a civilised manner, just annoying because these idiots hit our car and now are wasting our time.

Plus the back door doesn't open so we have a three door car.

I asked if I should have reported this and they advised to only call them if someone is injured. This is Sydney, so laws may be different elsewhere.

Probably so many accidents in Sydney that they don't have enough time to deal with them all! smile

I'm giving them til Saturday, keep calling every day, then I'll go to the cop shop.

Cheers guys, thanks for the advice.
