Car Warranty Issue

I've had a quick look and couldn't find anything that could help me out here.

I bought my car from a used car dealer, which was probably my first mistake. :angry:

I've encountered a problem with the car, which is the car shudders when I'm making a wide turn, but only happens when the car and engine is warm. Never happens when its cold. I've had a mechanic drive it whilst it was warm and told me that the gearbox was damaged and bits of it had gone into the diff.

So I've brought it back to the dealer since its within warranty and they've given it back to me after a day saying there was nothing wrong with it. I told them it was a gearbox issue and that it only occurs when it's warm, but obviously they've tested it when it was cold.

What avenues do I have in this instance? I've been told to lodge a complaint to the appropriate body (whoever they are), but I'd rather just have the car fixed and be done with. How can I prove to the dealer that the car is in fact faulty.

Also a side note, the mechanic checked the gearbox/diff oil and noted that the oil had been changed recently, and he reckons that someones noticed this and changed the oil thinking it would solve the problem.

Go to the ACCC or NSW's Automotive Chamber of Commers. Not sure what it's called - it's the VACC here in VIC.

hey mate-i went throught the same dramas with a used car salesman!i recomend u call the departmrnt of fair trading asap!they have a motor vehicle division who will be able to help you and give you advice.i also had a simliar problem to the noise u describe-turned out to be my viscous coupling(inside the gearbox)-search viscous coupling in here and u will find the write up-good luck mate!

So what finally made the dealer fix the problem? Did you tell them that you contacted Fair Trading or were they contacted by the motor vehicle division and then took action?

well i think in the long run they ended up fixing the car cause i just kept going back and hasseling them-but i did tell em that i had had advice from the fair trading motor division-which probably helped!.......pretty sure it will be your viscous coupling if it only happens when the car is hot-and u will be looking at $1500-$2000 to put a new one in-so its definately worth trying every possble way to get the pricks to pay!
